Terms of Agreement, Disclaimer and Creative Release

 

Purpose of Service

Message of the Heart LLC and Sharen Martinson provide original custom digital creations including artwork, written messages, lyrics, songs, music, symbolism, themes, imagery, and creative expression.  These creations are offered in digital format as is, as final sales. In the event of a special commission clients may provide information and choices of heart themes, musical preference.  Final creative interpretation remains solely the artistic choice of the creator.

Entertainment & Informational Disclaimer

Message of the Heart LLC offerings by Sharen Martinson are intended exclusively as creative, artistic, inspirational, and entertainment experiences.  They are not intended to diagnose, treat, heal, cure, counsel, coach, advise, evaluate or replace professional services of any kind in any way.  Nothing provided through Message of the Heart LLC constitutes:  Medical or healthcare advice, therapy, counseling, psychological services, or mental health treatment, coaching, mentoring, or consulting.  Legal, financial, business, or professional advice, crisis, trauma, or treatment support, predictive, factual, spiritual, psychic, or guaranteed guidance.  Any interpretation, emotional meaning, understanding, action or decision made by a recipient based upon the artwork, music, song, lyrics, written message, symbolism, or creative themes is entirely the responsibility of the recipient.  No guarantees, promises, outcomes, personal results, emotional effects or transformational experiences are expressed or implied.

Creative Process & Artistic Discretion

Message of the Heart LLC is a creative artistic offering.  The creator, Sharen Martinson, maintains complete artistic discretion regarding imagery, symbolism, colors, wording, lyrical content, musical style, emotional tone, artistic direction, thematic interpretation, final presentation.  By purchasing a digital download, or by placing a personal customized order, the client acknowledges they are purchasing a custom artistic creation, not directing or controlling the creative outcome.  Personal satisfaction, stylistic preference, interpretation, emotional resonance, or expectation of liking the finished product cannot be guaranteed.

No Revisions No Refunds - All Sales Final

All Message of the Heart LLC creations are custom digital works created specifically made for digital purchase as, is, with all sales being final.  In the case of a customized individual order, because of their personalized and creative nature:  All sales are final.  No refunds are provided.  On a custom order, no cancellations are allowed once the order is received after the work has begun.  No revisions, edits, rewrites, redesigns, lyric changes, art changes, musical changes, alternate versions, or modifications are included.  No changes may be requested before, during, or after completion and delivery.  Acceptance of these terms occurs upon purchase, payment, submission of information, download, or receipt of the completed work.

Copyright & License

All artwork, music, songs, lyric, writing, recordings, imagery, concepts, compositions, and related creative materials remain the sole intellectual property and copyrighted work of the creator.  Purchase grants the client a non-exclusive personal-use license only.  Clients may download, enjoy, privately share, display for personal use.  Clients may not sell, reproduce for commercial use, alter for resale, distribute commercially, license to others, monetize, use for merchandise branding, advertising, NFT's, business promotion, or financial gain without prior permission from the creator.  Purchase does not transfer copyright ownership.

Promotional Release

Unless otherwise agreed upon in writing, the creator retains the right to display, share, reproduce, excerpt, publish or promote completed creations through websites, portfolio, social media, You Tube video channels, marketing materials and related promotional platforms.  Reasonable efforts will be made to protect private identifying information.

Limitation of Liability

By purchasing, participating, downloading, or receiving a Message of the Heart LLC digital creation, the recipient acknowledges being at least 18 years old, releases and holds harmless Message of the Heart LLC and the creator from any claims, losses, damages, dissatisfaction, misunderstandings, emotional reactions, interpretations, expectations, personal decisions, indirect consequences, or liabilities connected to use, receipt, or perceived meaning of the creative work.

Agreement

By ordering, purchasing, submitting information, accessing, or downloading, or receiving any Message of the Heart LLC creation, you confirm that you have read, understood, and voluntarily agree to these Terms, Disclaimer and Creative Release. Contacting Message of the Heart, reading or listening to the website, or ordering any creations or digital products constitutes your agreement and acceptance of the Terms of Agreement, Disclaimer and Creative Release, and Privacy Policy with the Disclaimer of Warranties.
