Agreement and Deposit
Before Sharen Martinson begins work on your pet portrait painting, a written contract sent digitally will be made between Sharen and you verifying the agreed-upon payment and deposit. The payment is considered a donation or gift unless otherwise specified as a sale and is non-refundable once work has begun. Upon receipt of the deposit Sharen begins your pet portrait which will be completed within two weeks.
Artistic Expression
You agree to provide clear high-quality photographs of your animal and to select one main image to be used as the primary reference for the portrait. Sharen is not responsible for outcomes based on poor image quality or unclear reference materials. Canvas size is predetermined in the written agreement, and you may also specify your background color and tone. Sharen Martinson strives to capture the essence of your animal while maintaining artistic freedom and expression in the creation process. While she aims to capture your pet's spirit and likeness, please know this is a work of art - not an exact photo replica.
Approval Process and Delivery and Pickup
You will be given a digital preview of the portrait for review before finalization. Minor revisions may be required at that time. Once final approval is given in writing (e-mail) no further changes will be accepted. The full agreed donation, or sale payment, must be paid before finished artwork is released. Refunds are not available for completed and approved work.
Delivery and Pickup: Sharen Martinson does not offer shipping or delivery. You or your appointed agent are responsible for picking up the artwork at an agreed upon time and location. Responsibility and ownership of the artwork transfer to you upon pickup by you or your agent. Any damage occurring after this point is your sole responsibility.
Copyright and Usage
Limitation of Liability
Sharen Martinson retains full copyrights to all artwork unless otherwise agreed in writing. You may not reproduce, sell or publish the artwork without written permission. Sharen reserves the right to photograph and share images of the artwork for portfolio, marketing, and promotional purposes unless requested otherwise.
Limitation of Liability: Sharen Martinson is not liable for any damage, injury, allergic reaction, or issue related to materials used in the artwork once the piece is picked up. No guarantees are made regarding suitability for framing, environmental durability, or display conditions.
