You (The customer) should understand that by ordering any product or service you agree to be bound by these terms and conditions.

Gift Animal Poems

I understand Sharen Martinson will create a personalized poem for me using the information I provide on the order form. Sharen will return my completed poem within 72 hours by using the e-mail I sent the original order on.  Sharen Martinson cannot be held liable for any electronic or computer failure that keeps me from receiving my poem once it shows as SENT on her computer records, such as the poem going to my junk e-mail.  I understand I have been advised to add info@messageoftheheart.com to my contact list. I confirm I have been advised to take my time and write down all details of the story and names, places, memories, purpose of poem in order for Sharen to create my personalized poem.  I agree that Sharen cannot be held liable for leaving out any information in my poem that I have not included on my order form.  As such, I acknowledge any information not included on my original order form cannot be added in later after my preliminary poem is received.  Sharen will send me my copy once completed within 72 hours from her receiving it in her e-mail inbox.  I understand she will give me 24 hours to preview it for any spelling or grammar changes I see that need to be corrected, or perhaps a misunderstanding of the facts on my order form. This includes spellings, grammar, layout, colors, sizes, fonts, type of print.  I understand it is important that I, the customer, check that the spelling, grammar and word layout are correct and I agree with the tone and story of the poem.  I understand I have 24 hours to preview my first copy and notify Sharen Martinson of any changes of the original information, not new information, that I would like changed.    I understand she will then change these original facts and send me my finalized poem within 24 hours.  I understand I cannot add new information not included on my order form.  I understand I am allowed one preliminary viewing and changes from my original order, NOT changing the poem by giving of new information.

I understand it is solely my responsibility as the customer to check the Poem as mentioned above and to apply within 24 hours of receipt of the poem for any changes.  Sharen Martinson cannot be held responsible for any so called "errors" which are made with regards to the spelling, grammar, word layout, color if in color, size and type of font or content of the poem after this 24 hour period for requesting any changes, or once final changes recommended within the 24 hours have been completed per the instructions in the preview.  After this time when the final poem has been delivered with requested changes. Sharen Martinson will not make any further amends to the poem.  By ordering a poem, this indicates I have read and understand the terms and conditions for ordering and receiving a poem.  Sharen Martinson cannot be reached personally by telephone and all correspondence must be made through info@messageoftheheart.com.

All written Animal Intuitive Listening Messages of the Heart are for entertainment purposes only. They are meant to offer insight into your animal and to offer heart felt messages of inspiration between animal and caretaker.  Sharen Martinson makes no claims to offer advice of any kind on any level in any way. By submitting your order form you agree that: I understand I am recommended to consult a veterinarian for any physical issues, an animal behaviorist for any behavior issues, or any other professional to solve any problems or issues between me and my animal as these are not addressed in the written intuitive message.  Sharen Martinson makes no claim that the information she provides is true or applies to your specific animal.  Any written words are for upliftment and to foster a greater understanding of animals and their people.  These words can apply to all animals and people, as such, no guarantee or claims are made for any benefit beyond entertainment purposes only.

By supplying you with a finished product of either a written Gift Animal Poem or a written Animal Intuitive Listening Messages of the Heart you agree that Sharen owns the copyright.  You have permission to use your written end product sent via e-mail in partial or entirety whenever and wherever you wish, as long as it is used positively for good and as long as you identify the creator as Sharen Martinson at www.messageoftheheart.com.  You are not allowed to change the content or use in any way to defame or belittle or give out any negative reviews or use for negative purposes. All written text is under strict copyright @ Message of The Heart and Sharen Martinson. You may not modify or replicate any way except to post content for personal use giving credit to Sharen Martinson and not claiming to be the author.  You are not permitted to copy and distribute in any way, alter or tamper with or otherwise use on social media, the internet, or any public forum for your own personal benefit.   Under no circumstances will Sharen Martinson be responsible for any copyright issues arising as a result of you claiming the end product or misusing any/all text or information.  You understand you will be legally liable for the way you use any information and will need to correct, remove, or any other such action as Sharen Martinson directs for misuse of your written Gift Animal Poem or Animal Intuitive Listening Message of the Heart.

Delivery

Delivery of your written items are by info@messageoftheheart.com .

Sharen does not deliver by mail or any other means of delivery other than by e-mail provided by you.  In the event you need to notify her of a change you can use the contact form on the website Messageoftheheart.   Sharen is not liable for any missed delivery due to an e-mail change on your part.  Sharen is also not liable for timely delivery within the seventy-two hours if her system suffers from an internet outage beyond her control such as inclement weather or unforeseen circumstances.  If there is a delay Sharen will notify you as soon as possible.  She will not be held responsible or liable for any delay past the seventy-two hours, or twenty four hours allowed for preview.  By ordering and paying for any written service you agree to this statement: I understand that Sharen makes every attempt to keep delivery times as promised, but in the event of unforeseen emergencies or circumstances, she cannot be held responsible for not meeting the delivery time.  Sharen will make every effort to notify you of any delay when possible.

Returns and Refunds

Please note Sharen Martinson and Message of the Heart cannot accept returns or offer refunds on personalized products once you have received by e-mail your final product.   These items are personalized for you and have been produced for you, as the customer) to your requirements.  Once completed, the time is already spent on them and they cannot be sold to someone else.  By using Sharen's services you agree to this statement:  I understand Sharen Martinson and Message of The Heart offer no return or refunds of a final product once the twenty-four hours for preliminary review has passed on Gift Animal Poems, or she has sent the final poem after revisions.  Sharen Martinson offers no refunds or returns on her written Animal Intuitive Listening Messages of the Heart.  These written Messages are offered for entertainment purposes only. 

Events Outside Our Control

Sharen Martinson and Message of The Heart will not be liable or responsible for any failure to perform, or delay in performance of, any of her obligations under a contract that is caused by events outside reasonable control )Force Majeure Event.}  A Force Majeure Event includes any act, event, non happening omission or accident beyond Sharen's reasonable control and includes any act, event, non happening omission or accident beyond her reasonable control and includes in particular (without limitation} the following:  Strikes, lock outs, or other industrial action, civil commotion, riot,invasion, terrorist attack or threat or preparation for war, fire, explosion, storm, flood earthquake, subsidence, epidemic or other natural disaster, internet outage,or inability to use telecommunications networks, regulations or restrictions of any government.

Entire Agreement

These terms and conditions and any document referred to in them represent the entire agreement between us in relation to the subject matter of any contract and supercede any prior agreement, understanding or arrangment between us, whether oral or in writing, OR we intend to rely upon these terms and conditions and any document expressly referred to in them in relation to the subject matter of any contract made through ordering of services.  Sharen has the right to revise these terms and conditions from time to time to reflect changes affecting her products or services.  You will be subject to the policies and terms and conditions in force at the time you order products or services from Sharen Martinson at Message of The Heart.
